AG STEVE MARSHALL ANNOUNCES CONVICTION OF CHARLES TODD HENDERSON FOR PERJURY, MAKING HIM INELIBIGLE TO BE JEFFERSON COUNTY DISTRICT ATTORNEY

            (MONTGOMERY) –Attorney General Steve Marshall announced that Charles Henderson, who was elected District Attorney of Jefferson County last fall, was today convicted of first-degree perjury, a felony, which renders him ineligible to hold the office. Due to his indictment in January, Henderson was barred from assuming the office pending the outcome of his criminal trial.

            The conviction arises from testimony Henderson gave prior to his election, in a domestic relations case in Jefferson County. Henderson had served as a guardian ad litem for a child whose custody was at issue in the case. The testimony involved questions about an undisclosed relationship Henderson developed with the child’s mother prior to his appointment. He was asked whether he had spent the night with the woman, which he denied.  The Attorney General’s Special Prosecutions Division presented evidence that indicated he had in fact spent the night with the woman, to whom he now is married. 

            Attorney General Steve Marshall stated, "As Attorney General, and as a former District Attorney, I have a special appreciation for the requirement that witnesses be truthful in court proceedings. Those persons who violate the obligation to provide truthful testimony, especially those who are in a position of public trust, may expect to be held accountable. I want to express special appreciation for the jury's hard work, and for the hard work of those in my Special Prosecutions Division."

            A sentencing date for Henderson is not yet set. He faces a potential penalty of one to ten years imprisonment for first-degree perjury, a class C felony.
